    PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. This document constitutes a legally binding agreement between you (the "Client") and ED's Wicked Detail & Auto. By booking, scheduling, or receiving any service from ED's Wicked Detail & Auto, you acknowledge that you have read, understood, and unconditionally agree to be bound by all provisions set forth herein. If you do not agree to these Terms and Conditions, you may not use our services.

    ED's Wicked Detail & Auto is a premier, owner-operated auto detailing business serving Mason City, Iowa and surrounding areas. We are dedicated to delivering the highest standard of hands-only professional detailing — The Wicked Standard — with integrity, precision, and pride. Every vehicle we touch is treated with the same relentless attention to detail that defines who we are. We are not just a detail shop. We are an experience. The business is owned and operated by head technicians Eric and Devon.

    2. Definitions

    As used throughout these Terms and Conditions, the following terms shall have the meanings set forth below:

    A. "Company," "We," "Us," or "Our" refers to ED's Wicked Detail & Auto, its owners Eric and Devon, employees, contractors, agents, and authorized representatives acting on behalf of the business.

    B. "Client," "You," or "Your" refers to any individual, entity, or authorized representative who books, schedules, receives, or inquires about services from the Company, whether in person, by phone, text message, or through any digital platform.

    C. "Vehicle" means any automobile, truck, SUV, van, or similar motor vehicle submitted to the Company for detailing services, regardless of make, model, year, or condition.

    D. "Service(s)" means any auto detailing package, add-on service, specialty treatment, or individual offering provided by the Company, as communicated to the Client at the time of booking or inspection, including but not limited to interior detailing, exterior hand washes, paint decontamination, ceramic coating, and odor elimination.

    E. "Appointment" means a confirmed booking between the Client and the Company, inclusive of an agreed-upon date, time, location, and scope of service, and acknowledged as confirmed by explicit communication from the Company.

    F. "Biohazard Material" means any substance or material present in or on the Vehicle that poses a potential health risk, safety hazard, or contamination concern to Company technicians, including but not limited to: vomit, blood, urine, feces, bodily fluids of any kind, mold or mildew infestations, used syringes or needles, drug paraphernalia of any nature, or any other substance reasonably determined by the Company to constitute a hazard.

    G. "Hands-Only Detailing" means that all cleaning, polishing, treatment, and restoration services performed by the Company are executed entirely by hand, utilizing professional-grade tools, cloths, brushes, and industry-standard products. No automated car wash equipment or mechanical polishing machines are used unless explicitly agreed upon and stated in writing by the Company prior to service.

    H. "Pre-Existing Condition" means any damage, defect, staining, fading, rust, worn trim, mechanical fault, or other imperfection present on or within the Vehicle prior to the commencement of any Service by the Company.

    I. "Deposit" means any upfront payment collected by the Company prior to the rendering of Services, used to reserve an Appointment or secure a scheduled service slot.

    3. Acceptance of Terms

    A. Agreement by Booking. By booking an Appointment with the Company — whether in person, by telephone, text message, social media message, online form, or any other platform designated by the Company — the Client acknowledges that they have read, fully understood, and unconditionally agree to be bound by these Terms and Conditions in their entirety. No separate signature is required for this agreement to be valid and enforceable.

    B. Legally Binding Agreement. These Terms and Conditions constitute a legally binding agreement between the Client and ED's Wicked Detail & Auto. This agreement is enforceable to the full extent permitted under the laws of the State of Iowa.

    C. Right to Modify Terms. The Company reserves the right to update, amend, or modify these Terms and Conditions at any time without prior notice. The most current version of these Terms will govern all services rendered from the posted effective date forward. Continued use of the Company's services following any amendment constitutes the Client's acceptance of the revised Terms.

    D. Capacity to Contract. By booking a Service, the Client represents and warrants that they are at least eighteen (18) years of age and possess the full legal capacity to enter into this agreement, or are acting as the duly authorized agent or guardian of the registered vehicle owner.

    4. Services

    A. Scope of Services. ED's Wicked Detail & Auto provides premium, professional, hands-only auto detailing services. Our offerings include, but are not limited to:

    • Full interior detailing (vacuuming, steam cleaning, surface treatment, leather conditioning, odor elimination)
    • Exterior hand washes, clay bar decontamination, and hand-applied wax or sealant
    • Paint decontamination and surface correction treatments
    • Ceramic coating application
    • Odor elimination treatments
    • Engine bay cleaning (where applicable and agreed upon)
    • Specialty add-on services as offered by the Company at the time of booking

    All services are performed exclusively by hand using professional-grade tools and industry-standard products. No automated car wash equipment, conveyor systems, or mechanical polishing machines are used in any standard service unless explicitly stated otherwise in writing by the Company.

    B. Service Limitations. The Company does not and cannot guarantee the complete removal of all stains, scratches, paint defects, odors, or imperfections — particularly those that are deeply embedded, chemically bonded, permanent in nature, or caused by neglect, age, excessive UV exposure, prior misuse, or damage pre-dating the service. Results may vary substantially based on:

    • The overall age and condition of the Vehicle
    • The duration and severity of staining, soiling, or damage
    • The condition and type of paint, interior materials, or surfaces
    • Compatibility of existing coatings or treatments with Company products

    The Company is not responsible for outcomes that are inherently limited by the Vehicle's Pre-Existing Condition, and no Service shall be deemed incomplete or inadequate solely on the basis of such limitations.

    C. Pre-Existing Condition Acknowledgment. Prior to commencing any Service, the Company may — at its sole discretion — document the Vehicle's condition via photographs, video, written notes, or other reasonable means. Clients are strongly encouraged to disclose all known Pre-Existing damage, defects, or special circumstances prior to the start of any Service. The Company assumes no liability for Pre-Existing Conditions, and the existence of such documentation shall serve as conclusive evidence of the Vehicle's condition at the time service commenced.

    5. Appointments & Scheduling

    A. Booking. Appointments may be booked by telephone, text message, or any platform officially designated by the Company. All appointment requests are subject to availability. An Appointment is not considered confirmed until the Client has received explicit written or verbal confirmation directly from the Company. Requests submitted through unofficial channels or without Company acknowledgment do not constitute confirmed Appointments.

    B. Arrival & Vehicle Access. The Client is responsible for ensuring that the Vehicle is fully accessible, unlocked (where applicable), and ready for service at the scheduled Appointment time and location. If the Company arrives at the designated service location and is unable to access the Vehicle due to Client error, absence, or obstruction, the Appointment may be treated as a same-day cancellation or no-show and subject to the applicable fees set forth in Section 6.

    C. Vehicle Condition at Time of Service. The Client agrees to present the Vehicle in a reasonably accessible state. Excessive clutter, personal belongings, or contents that inhibit the Company's ability to perform Services may result in additional charges or, at the Company's discretion, rescheduling of the Appointment.

    D. Right to Refuse Service. ED's Wicked Detail & Auto reserves the absolute right to refuse, suspend, or discontinue any Service at any time, for any reason, at the Company's sole discretion. Non-exhaustive grounds for refusal include:

    • Unsafe, hazardous, or inaccessible working conditions
    • Discovery of undisclosed Biohazard Material
    • Presence of illegal substances, items, or materials in or on the Vehicle
    • Abusive, threatening, or harassing behavior directed toward Company personnel
    • Vehicle condition that materially differs from what was described at the time of booking
    • Non-payment or outstanding balance from prior services

    In the event of service refusal, any Deposit paid may be forfeited in accordance with these Terms.

    6. Cancellation Policy

    ⚠ Cancellation Notice Requirement

    All cancellations and reschedules require a minimum of 24 hours' advance notice. Failure to provide timely notice will result in the fees described below.

    A. Standard Cancellation. Clients who need to cancel or reschedule their Appointment must notify the Company at least twenty-four (24) hours before the scheduled Appointment time. Cancellations made with proper advance notice will not incur a cancellation fee. Cancellations made with less than twenty-four (24) hours' notice may be subject to a cancellation fee of up to $150.00, assessed at the Company's discretion based on the circumstances.

    B. Same-Day Cancellations & No-Shows. Cancellations made within two (2) hours of the scheduled Appointment time, and Appointments for which the Client fails to be present or make the Vehicle available without prior notice ("No-Shows"), will be charged a mandatory No-Show Fee of $150.00. This fee is non-negotiable and is due immediately upon assessment. Clients with a history of repeat No-Shows may, at the Company's sole discretion, be required to prepay in full for all future services or may be denied future bookings entirely.

    C. Company-Initiated Cancellations. In the event the Company is required to cancel an Appointment due to weather conditions, equipment issues, technician illness, or other unforeseen emergencies, the Client will be notified as promptly as reasonably possible. The Client will be offered a full reschedule at no additional cost. The Company shall not be liable for any direct or indirect inconvenience, loss, or damages arising from a necessary Company-initiated cancellation.

    D. Rescheduling. Each Client is entitled to one (1) complimentary reschedule per Appointment, provided the request is made no less than twenty-four (24) hours before the scheduled time. Rescheduling requests made within twenty-four (24) hours of the Appointment are subject to the same fee structure as standard cancellations under Subsection A above (up to $150.00). Subsequent rescheduling of the same Appointment may require a non-refundable Deposit to hold the new time slot.

    7. Biohazard Policy

    A. Biohazard Definition. For purposes of these Terms, "Biohazard Material" includes, but is not limited to, the following substances when present in or on any Vehicle submitted for service:

    • Vomit, blood, urine, feces, or other human or animal bodily fluids
    • Mold, mildew, or fungal infestations of any extent
    • Used syringes, needles, or any paraphernalia associated with drug use
    • Any illegal controlled substance or residue thereof
    • Any other material, substance, or condition reasonably determined by the Company to constitute a health, safety, or contamination hazard to the technician or surrounding environment

    ⚠ BIOHAZARD FEE: $200.00

    NON-NEGOTIABLE — AUTOMATICALLY ASSESSED UPON DISCOVERY

    This fee applies regardless of prior disclosure or lack thereof, in addition to all scheduled service charges, and is due immediately upon discovery of any Biohazard Material.

    ⚠ SERVICE STOPS IMMEDIATELY UPON BIOHAZARD DISCOVERY

    Upon discovery of any biohazard material, all detailing services will CEASE IMMEDIATELY and automatically. No further work will be performed on the vehicle until the biohazard situation is resolved. The Client will be notified of the discovery and the service stoppage as soon as it is safe and practicable to do so.

    If the Client cannot be reached by phone, text, or any available contact method within a reasonable time following discovery, the vehicle will remain in its current state and the Company will document the condition via photographs. The $200.00 Biohazard Remediation Fee will still apply and will be due in full before any service resumes or the vehicle is released. The Company assumes no liability for any condition of the vehicle during the period in which the Client is unreachable.

    B. Mandatory Biohazard Remediation Fee. Upon discovery of any Biohazard Material in or on the Vehicle — whether disclosed in advance or not — a mandatory, non-negotiable Biohazard Remediation Fee of $200.00 will be automatically assessed and added to the Client's total balance due. This fee:

    • Is assessed in addition to the full cost of the originally scheduled Service
    • Is due immediately upon discovery and assessment by the technicians
    • Is non-refundable under all circumstances
    • Is not subject to negotiation, reduction, or waiver for any reason
    • Applies regardless of whether the Client claims to have been unaware of the biohazard condition

    C. Client Disclosure Obligation. Clients are affirmatively required to disclose the known or suspected presence of any Biohazard Material at the time of booking — prior to the Appointment. This obligation is a material condition of this agreement. Failure to disclose known Biohazard Material conditions constitutes a breach of these Terms and Conditions and may result in:

    • Immediate refusal of service without refund of any Deposit or prepayment
    • Assessment of the full $200.00 Biohazard Remediation Fee regardless of service completion
    • Permanent denial of future bookings at the Company's discretion

    D. Service Refusal — Biohazard. The Company reserves the absolute right to refuse Biohazard remediation if, upon inspection, the technicians determine in their sole judgment that conditions are unsafe, unmanageable, or beyond the scope of the Company's offered remediation services. In such cases, the Client will be charged a $50.00 Assessment Fee to compensate the technicians for time and travel, and the Appointment will be deemed terminated. No further service will be rendered, and any Deposit paid will be forfeited.

    E. Health & Safety of Technicians. The health and safety of ED's Wicked Detail & Auto technicians is of the utmost importance and will not be compromised under any circumstances. All biohazard handling undertaken by the Company is performed at the technicians' sole discretion, using appropriate protective equipment deemed sufficient for the conditions encountered. The Client acknowledges and agrees that ED's Wicked Detail & Auto is not a licensed biohazard remediation firm; any biohazard-adjacent services offered are provided as a professional courtesy and are limited in scope to what is safely achievable by professional auto detailing technicians.

    8. Payment Terms

    A. Pricing. All service pricing is communicated to the Client at the time of booking or upon inspection of the Vehicle, whichever is applicable. Prices are subject to adjustment based on Vehicle size, Vehicle condition, scope of work required, and any material discrepancy between the condition described by the Client at the time of booking and the actual condition discovered upon inspection. The Company reserves the right to revise a quoted price prior to commencing work if the Vehicle's condition substantially differs from what was represented. The Company will communicate any pricing adjustments to the Client before proceeding.

    B. Payment Methods. Payment for all Services is due in full upon completion of the scheduled Service unless an alternative arrangement has been agreed upon in writing by the Company in advance. Accepted payment methods will be clearly communicated to the Client at the time of booking or at the time of service completion. The Company reserves the right to require prepayment or Deposits for select services, premium packages, or Clients with a history of No-Shows or non-payment.

    C. Deposits. Non-refundable Deposits may be required at the Company's discretion, particularly for:

    • Premium or multi-stage services (e.g., ceramic coating, full paint correction)
    • Large vehicles or extended-duration jobs
    • Clients who have previously No-Showed or cancelled within the restricted window
    • Any booking at the Company's discretion

    All Deposits are non-refundable and will be forfeited in full in the event of a No-Show, a cancellation within the restricted cancellation window, or a refusal of service for cause.

    D. Late Payments. Any balance not settled at the time of service completion may accrue a late fee at the Company's discretion. The Company reserves the right to pursue collection of any outstanding balances through all appropriate legal and civil channels available under Iowa law, including but not limited to small claims proceedings, collections referral, or legal action. The Client shall be responsible for all reasonable costs of collection, including court filing fees.

    9. Liability & Limitation of Liability

    A. General Liability. ED's Wicked Detail & Auto takes every reasonable professional precaution to protect and care for Client vehicles during the service process. However, to the fullest extent permitted by applicable law, the Company shall not be liable for:

    • (i) Any Pre-Existing Condition, damage, defect, fading, or imperfection present on the Vehicle prior to service commencement;
    • (ii) Damage caused by inherently defective, fragile, weakened, aged, or improperly installed vehicle components that are not reasonably apparent prior to service;
    • (iii) Incidental, consequential, indirect, special, or punitive damages of any kind arising from or related to the provision or non-provision of Services;
    • (iv) Any damage arising from the Client's failure to disclose material information about the Vehicle's condition prior to service.

    B. Maximum Liability Cap. In the event that the Company is found legally liable for direct damage to a Vehicle caused solely by the Company's demonstrable negligence during an active service session, the Company's total maximum liability shall not exceed the total monetary amount charged to the Client for the specific Service during which the damage occurred. Under no circumstances shall the Company's liability exceed this amount.

    C. Personal Property. The Client is solely responsible for removing all personal items, valuables, electronics, currency, documents, irreplaceable objects, and any other personal property from the Vehicle prior to the commencement of any Service. The Company is not responsible for and shall not be liable for any personal property that is lost, damaged, misplaced, or reported missing from the Vehicle during or after the service period. The Client's failure to remove personal property constitutes a waiver of any claim related to such property.

    D. Force Majeure. The Company shall not be liable for any delay, interruption, or failure to perform Services that is caused by circumstances beyond the Company's reasonable control, including but not limited to: severe weather events, natural disasters, acts of God, public health emergencies, supply chain disruptions, road closures, utility outages, or any other event not reasonably foreseeable or controllable by the Company.

    10. Client Responsibilities

    By booking and receiving Services from ED's Wicked Detail & Auto, the Client expressly agrees to and accepts the following responsibilities:

    • Accurate Disclosure: The Client agrees to provide accurate, truthful, and complete information regarding the Vehicle's condition, history, known damage, and any special circumstances at the time of booking and prior to service commencement.
    • Biohazard Disclosure: The Client agrees to proactively disclose any known or suspected Biohazard Material present in or on the Vehicle before the Appointment, in accordance with Section 7 of these Terms.
    • Vehicle Accessibility: The Client agrees to ensure the Vehicle is present, accessible, unlocked (where required), and ready for service at the confirmed Appointment time and location.
    • Personal Property Removal: The Client agrees to remove all personal belongings, valuables, and irreplaceable items from the Vehicle prior to the start of any Service, as set forth in Section 9(C).
    • Respectful Conduct: The Client agrees to treat all Company technicians and representatives with courtesy and respect at all times. Abusive, threatening, discriminatory, or harassing behavior — whether verbal, written, or physical — directed toward any Company personnel will result in the immediate termination of service. The Client will be charged for all time, labor, and materials expended up to the point of termination. The Company reserves the right to permanently deny future service to any Client who engages in such conduct.
    • Payment Obligation: The Client agrees to render full payment for all Services rendered and all applicable fees assessed in accordance with these Terms and Conditions, at the time of service completion or as otherwise agreed in writing.

    11. Satisfaction Guarantee & Disputes

    A. The Wicked Satisfaction Standard. ED's Wicked Detail & Auto takes immense pride in delivering wicked results on every vehicle we touch. Client satisfaction is not an afterthought — it is the standard we hold ourselves to every single day. If a Client is unsatisfied with any aspect of the Service rendered, they must notify the Company in writing or by direct communication within twenty-four (24) hours of the service completion time. Concerns raised beyond this window may not be eligible for remediation.

    B. Remediation Process. Upon receipt of a timely and legitimate concern, the Company will make reasonable, good-faith efforts to address the issue. At the Company's sole discretion, remediation may include a complimentary touch-up or spot re-clean performed at a mutually agreed upon time. The Company's determination of what constitutes a legitimate concern versus a limitation of service (as described in Section 4B) is final.

    C. No Refund After Re-Clean. Once a complimentary re-clean, touch-up, or any form of remediation service has been performed by the Company in response to a Client concern, no further refunds, credits, discounts, or additional remediation shall be issued or performed for that same service or service session. All issues are considered resolved upon completion of the remediation.

    D. Dispute Resolution. Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, or the Services provided hereunder, shall first be addressed through direct, good-faith communication between the Client and the Company. The parties agree to make reasonable efforts to resolve disputes informally before pursuing formal legal action. If a dispute cannot be resolved through good-faith communication, it shall be subject to the laws of the State of Iowa and resolved exclusively in the courts of competent jurisdiction located in Cerro Gordo County, Iowa. The Client irrevocably consents to the personal jurisdiction and venue of such courts.

    12. Photography & Marketing

    A. Right to Photograph. The Company may photograph, record, or otherwise document Client Vehicles before, during, and after any Service for the purposes of quality control, condition documentation, internal records, and marketing.

    B. License to Use. By agreeing to these Terms and Conditions, the Client grants ED's Wicked Detail & Auto a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, and distribute photographs or video content of the Vehicle (exterior only, without personally identifying information) for marketing, advertising, social media, website, and promotional purposes.

    C. Opt-Out. If the Client does not consent to the use of Vehicle photographs for marketing or promotional purposes, the Client must notify the Company clearly and in writing prior to the commencement of the Appointment. The Company will honor all opt-out requests made in accordance with this provision. Opt-out requests made after service commencement may not be applied retroactively to content already captured.

    D. No Personal Information. The Company will not publish any personally identifying Client information (including name, license plate numbers, or contact details) in any marketing content without the Client's express written consent.

    13. Privacy

    A. Information Collected. The Company collects limited personal information from Clients solely for the purpose of scheduling, communication, service delivery, and record-keeping. This information may include: Client name, phone number, email address, Vehicle make, model, year, and license plate number.

    B. Use of Information. Client information is used exclusively for legitimate business purposes including Appointment confirmation, service-related communication, payment processing, and record retention. The Company will not use Client information for unsolicited mass marketing without consent.

    C. No Sale of Data. The Company will not sell, trade, rent, or otherwise transfer Client personal information to any third party, except as may be required by applicable law, court order, or valid legal process.

    D. Data Security. The Company takes reasonable precautions to protect Client information from unauthorized access or disclosure. However, the Company cannot guarantee absolute security of information transmitted electronically.

    14. Governing Law

    These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Iowa, without regard to its conflict of laws principles. All legal proceedings arising out of or relating to these Terms or the Services provided hereunder shall be brought exclusively in a court of competent jurisdiction located in Cerro Gordo County, Iowa. Both parties hereby irrevocably consent to the personal jurisdiction and venue of said courts for such purpose.

    15. Severability

    If any provision, clause, or portion of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to render it enforceable, or if modification is not possible, severed from these Terms. All remaining provisions shall continue in full force and effect and shall not be affected by the invalidity or unenforceability of any individual provision. The parties agree that their intent shall be carried out to the greatest extent possible.

    16. Entire Agreement

    These Terms and Conditions, together with any written service quotes, Deposit receipts, or written amendments signed by both parties, constitute the entire agreement between ED's Wicked Detail & Auto and the Client with respect to the subject matter contained herein. This agreement supersedes all prior and contemporaneous discussions, negotiations, representations, understandings, communications, and agreements — whether written or oral — between the parties relating to the same subject matter. No oral modification of these Terms shall be binding. Any amendment must be made in writing and acknowledged by an authorized representative of the Company.

    17. Acknowledgment & Signature

    BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ, FULLY UNDERSTOOD, AND VOLUNTARILY AGREE TO ALL OF THE TERMS AND CONDITIONS OF ED'S WICKED DETAIL & AUTO AS SET FORTH IN THIS DOCUMENT. I further acknowledge that this agreement is legally binding, that I have had the opportunity to seek independent legal counsel, and that my signature constitutes full and unconditional acceptance of these Terms.
